Terms of Service

1. Account Registration and Verification

• To use our Services, you must submit an application and be approved by X-Link. You must provide accurate and complete information as part of our Know-Your-Customer (KYC) process.
• You must be a registered business or an individual of at least the age of majority in your jurisdiction. You represent that you are duly authorized to enter into this agreement.
• You are responsible for maintaining the security of your account credentials. You must immediately notify us of any unauthorized use of your account.

2. Use of Services

• You may only use the Services for legitimate business transactions. You may not use the Services for personal transactions or for any illegal activities or restricted businesses as defined in our policies.
• You are responsible for your relationship with your customers, including providing customer service, refunds, and handling disputes. You must ensure that your customers consent to their transaction being processed by X-Link.
• You agree to comply with all applicable laws, regulations, and payment network rules (e.g., Visa, Mastercard).

3. Fees, Payouts, and Reserves

• You agree to pay the fees for the Services as listed on our Pricing page. We reserve the right to change our fees with prior notice.
• We will settle the proceeds of your transactions to your nominated bank account, net of our fees, chargebacks, refunds, and any other applicable deductions.
• We reserve the right to hold funds in reserve if we determine there is a high level of risk associated with your account.

4. Chargebacks and Refunds

• You are fully liable for all chargebacks, refunds, and disputes related to your transactions. You agree to reimburse us for any such costs.
• You are responsible for providing refunds to your customers in accordance with your policies and applicable laws.

5. Intellectual Property

X-Link retains all rights, title, and interest in and to our Services, including our website, APIs, and trademarks. We grant you a limited, non-exclusive license to use our Services in accordance with these Terms.

6. Term and Termination

• This agreement is effective upon your account approval and continues until terminated by either you or us.
• We may suspend or terminate your access to the Services at any time, for reasons including but not limited to violation of these Terms or engaging in fraudulent or high-risk activity.
• Upon termination, you remain liable for all obligations, including fees and chargebacks, incurred prior to termination.

7. Limitation of Liability and Disclaimer

• The Services are provided 'as is' without any warranty. We do not guarantee that the Services will be error-free or uninterrupted.
• In no event will X-Link be liable for any lost profits, indirect, or consequential damages arising out of this agreement or the use of our Services.

8. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which is established, without regard to its conflict of law provisions.
